Agreement to Terms

By accessing or using Ictinus, you agree to be bound by these Terms of Service. If you don't agree, please don't use our service.

You must be at least 16 years old to use Ictinus. If you're using Ictinus on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

These terms constitute a legally binding agreement between you and Ictinus Ltd ("Ictinus", "we", "us", "our").

Description of Service

Ictinus is an AI-powered platform designed for property and real estate professionals. Our services include:

Design visualization — Generate architectural and interior design concepts from prompts, sketches, and reference images
Avatar videos — Create AI-generated talking head videos for property marketing and promotion
Marketing assets — Produce visual content for property listings, presentations, and campaigns

Our platform is designed for architects, interior designers, real estate agents, property developers, and marketing professionals in the property sector.

Feature availability may vary by subscription plan, and we may introduce, modify, or retire features at any time.

Account Terms

To use Ictinus, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your password
Accept responsibility for all activity under your account
Notify us immediately at support@ictinus.app if you suspect unauthorised access

One account per person. Account sharing is not permitted. If you need multiple users, please contact us about team plans.

Subscriptions, Credits & Payments

Free Trial

When you sign up, you receive a small number of free credits to experience the platform. Free trial outputs are eligible for commercial use with no restrictions.

Subscription Plans

Ictinus operates on a monthly subscription model:

Subscriptions are billed monthly in advance
Each plan includes a set number of credits per billing cycle
Subscriptions auto-renew until cancelled
We'll notify you at least 30 days before any price changes

Credits System

Rule	Detail
Allocation	Credits are allocated at the start of each billing cycle
Rollover	Unused credits do not roll over to the next cycle
Top-ups	Additional credit packs can be purchased anytime
Top-up expiry	Top-up credits also expire at the end of your billing cycle
Usage	Different generation types may consume different credit amounts

Cancellation

You can cancel your subscription at any time from your account settings:

Your subscription remains active until the end of the current billing period
You retain access to all features until that date
Unused credits are forfeited upon cancellation
We recommend downloading any content you wish to keep before cancelling

Refunds

We offer pro-rata refunds on request. Contact support@ictinus.app with your refund request and we'll process it within 14 days. Refunds are issued to the original payment method.

Failed Payments

If a payment fails, we'll retry automatically and notify you by email. If payment cannot be collected after multiple attempts, your subscription may be suspended until payment is resolved.

Intellectual Property

Your Content (Inputs)

You retain full ownership of any content you upload to Ictinus, including sketches, photographs, reference images, and prompts.

By uploading content, you grant us a limited licence to process, store, and transmit that content solely for the purpose of providing the service to you. This licence ends when you delete your content or account.

You are responsible for ensuring you have the rights to upload any content. This includes:

Copyright ownership or licence for images and designs
Consent from any individuals depicted in photographs
Rights to use any trademarks or branded materials

Generated Content (Outputs)

You own the content generated by Ictinus from your prompts and inputs. This ownership is granted upon successful credit use (including free trial credits).

You may use generated content for any lawful purpose, including commercial use, without attribution to Ictinus. However, you are responsible for ensuring your use complies with applicable laws and regulations.

Our Content

Ictinus, including our branding, user interface, software, and documentation, remains our intellectual property. You may not copy, modify, distribute, or reverse-engineer any part of our platform.

Acceptable Use Policy

You agree to use Ictinus responsibly and lawfully. You must NOT:

Generate harmful content:

Illegal, abusive, or harassing content
Content that exploits or endangers minors
Content promoting violence, discrimination, or hatred
Sexually explicit content

Create deceptive content:

Misleading property representations (e.g., fake views, non-existent amenities)
Fake reviews or testimonials
Non-consensual avatar videos impersonating real people
Content designed to defraud or deceive consumers

Abuse the platform:

Attempt to reverse-engineer, extract, or copy our AI models
Circumvent usage limits, access controls, or security measures
Use automated systems to access the service without permission
Resell or redistribute access to Ictinus
Use outputs to train competing AI systems

Violate regulations:

Breach real estate advertising standards in your jurisdiction
Violate consumer protection laws
Infringe third-party intellectual property rights

We reserve the right to suspend or terminate accounts that violate these policies.

AI & Generated Content Disclaimers

Important: AI-generated content has limitations. Please read this section carefully.

Design Visualizations

AI-generated designs are for visualization and conceptual purposes only. They are NOT:

Architectural drawings or construction documents
Engineering specifications or structural calculations
Certified for building code compliance
Reviewed for safety, feasibility, or buildability

Professional review is required before any real-world application. We strongly recommend consulting qualified architects, engineers, and local planning authorities before acting on any AI-generated design concept.

Ictinus does not guarantee that generated designs are structurally sound, code-compliant, or suitable for construction. You assume all responsibility for any real-world application of generated content.

Avatar Videos

AI-generated avatar videos are powerful tools that come with responsibilities:

Disclosure — Where required by law or platform policies, clearly identify AI-generated videos as such
Consent — If creating an avatar based on a real person, you must have their explicit consent
Identity — Do not use avatar videos to deceive viewers about who is speaking
Accuracy — Ensure any claims made in videos are truthful and substantiated

You are responsible for compliance with advertising standards and regulations in your jurisdiction.

Property Marketing

When using Ictinus for property marketing:

Generated content should accurately represent properties
Do not create misleading impressions about property features, views, or conditions
Comply with local real estate advertising laws and regulations
Disclose when images are AI-generated if required by your jurisdiction or industry standards

We do not guarantee that generated marketing content meets specific regulatory requirements in your region. You are responsible for ensuring compliance.

Availability & Support

Ictinus is provided on an "as-is" basis. While we strive for high availability, we do not guarantee uninterrupted access.

We may occasionally:

Perform scheduled maintenance (with reasonable advance notice where possible)
Experience unplanned downtime due to technical issues
Modify, update, or discontinue features

Support is available via email at support@ictinus.app. We aim to respond to all enquiries within 2 business days.

Termination

By You

You can cancel your subscription and close your account at any time from your account settings. Before doing so:

Download any content you wish to keep
Note that unused credits will be forfeited
Request a pro-rata refund if desired

By Us

We may suspend or terminate your account:

Immediately for serious violations of these terms, including generating harmful content or attempting to abuse our systems
With 30 days notice for any other reason, including discontinuation of the service

Effect of Termination

Upon termination:

You lose access to the Ictinus platform
Your generation history and saved projects become inaccessible
Content you've already downloaded remains yours
We may delete your data in accordance with our Privacy Policy

Limitation of Liability

To the maximum extent permitted by law:

Our total liability to you for any claims arising from your use of Ictinus is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, revenue, or business opportunities
Loss of data or content
Business interruption
Real-world outcomes from AI-generated designs
Third-party claims regarding avatar likeness or intellectual property
Regulatory fines or penalties arising from your use of generated content

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Ictinus Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the service
Content you upload or generate
Your violation of these terms
Your violation of advertising, real estate, or consumer protection regulations
Third-party claims related to intellectual property or likeness rights in your content

Governing Law & Disputes

These terms are governed by the laws of England and Wales.

Before initiating any legal action, you agree to contact us at legal@ictinus.app to attempt informal resolution. We'll work in good faith to resolve any dispute within 30 days.

If informal resolution fails, any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to Terms

We may update these terms from time to time. When we make changes:

We'll update the "Last Updated" date on this page
For material changes, we'll notify you by email at least 30 days in advance
Continued use of Ictinus after changes take effect constitutes acceptance

If you don't agree with updated terms, you may cancel your subscription before the changes take effect.

Previous versions of these terms are available upon request.

We aim to respond to all legal enquiries within 5 business days.
